1. Acceptance of Terms

By accessing or using the Toybetty Foods website (www.toybettyfoods.com), placing an order, or engaging any of our services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use our website or services.

These Terms of Service are governed by the laws of the Federal Republic of Nigeria.

Toybetty Foods provides the following services:

3. Orders and Payment

Placing Orders

Orders may be placed via our website contact form, WhatsApp, email, or direct telephone. An order is confirmed only when you receive written or electronic confirmation from Toybetty Foods.

Pricing

All prices are displayed in Nigerian Naira (₦) and are inclusive of applicable VAT unless otherwise stated. Prices are subject to change without notice, but confirmed order prices will not be changed after confirmation.

Payment

We accept payment by bank transfer, mobile payment platforms, and other methods communicated at the time of order confirmation. Full or partial advance payment may be required for catering and bulk orders. Payment details will be provided upon order confirmation.

Advance Payment: Catering orders above ₦50,000 require a minimum 50% deposit to secure the booking. The balance is due 24 hours before delivery or event date.

4. Delivery and Fulfilment

Delivery Areas

We currently deliver within Lagos State and select other locations by arrangement. Delivery coverage, timelines, and fees will be communicated at the time of order confirmation.

Delivery Times

We make every effort to deliver on the agreed date and time. However, Toybetty Foods shall not be liable for delays caused by circumstances beyond our reasonable control, including traffic, weather, or third-party logistics failures.

Perishable Nature of Products

All food products are perishable. It is your responsibility to ensure someone is available to receive deliveries and to store food appropriately upon receipt. Toybetty Foods is not responsible for spoilage resulting from delayed collection or improper storage after delivery.

5. Cancellations and Refunds

If we are unable to fulfil your order for any reason, we will notify you as soon as reasonably practicable and provide a full refund or an alternative arrangement. We will not be liable for any consequential losses arising from cancellation.

Complaints and Food Quality

If you are dissatisfied with the quality of food received, please notify us within 2 hours of delivery with photographic evidence. We will investigate and, where appropriate, offer a replacement, credit, or partial refund.

Our wellness meal plans are designed by qualified nutrition professionals and are intended to support, not replace, medical care. We strongly advise that you:

You may not reproduce, distribute, or create derivative works from our content without express written permission.

The Toybetty Foods name, logo, and brand marks are proprietary. Unauthorised use of our brand is prohibited.

9. Limitation of Liability

To the fullest extent permitted by Nigerian law, Toybetty Foods shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our services, including but not limited to loss of profits, data, or goodwill.

Our total liability to you for any claim arising from these terms or our services shall not exceed the amount you paid for the specific order giving rise to the claim.

10. Indemnification

You agree to indemnify and hold harmless Toybetty Foods, its staff, and partners from any claims, damages, costs, and expenses (including legal fees) arising from your breach of these Terms, your misuse of our services, or your violation of any third-party rights.

11. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria. Any disputes arising from these Terms shall first be subject to good-faith negotiation. If unresolved, disputes shall be referred to the courts of Lagos State, Nigeria.
